They – along with other 75 property owners in Ideal Homes Layout – were issued notices on September 28 for alleged encroachment of the stormwater drain in Rajarajeshwarinagar. While SS Hospital owned by Shamanur Shivashankarappa has encroached upon 22 guntas of land, Darshan's house has encroached upon 2 guntas of land.In his response, veteran Congress leader Shamanur Shivashankarappa has said that the land is still under lease hence, they are not guilty of encroachment. Actor Darshan’s family has stated that they bought the property in 2006 from Vanitha Khanna. Since the BDA gave them permission, it does not amount to encroachment of government land. When contacted, an official from the land records, survey and settlement department said, “We are yet to go through the documents of land ownership, sale deed and responses given by Shamanur Shivashankarappa, Darshan and other property owners in the Ideal Homes Layout. The report will be submitted in a week’s time to deputy commissioner.”A few other property owners claimed that they purchased the land from BDA and the agency should be consulted before any action is initiated against them.
