Poojary, a resident of Yellathur village in Mangaluru taluk, was charged under Section 302 of the Indian Penal code. Poojary hacked his mother Rithi Poojary (61) and sister Vimala (25) to death on December 11, 2009. While there was no strong reason for his act, he claimed that he was mentally unstable and hence he committed the crime. But there was nothing to substantiate his claims through medical records. The court had directed to hold medical checks-up at National Institute of Mental Health and Neuroscience. Medical reports claimed that Poojary was mentally unstable. But the court took the cognisance of the fact that he was not under any medication while committing the murder and charged him with murder. The court also slapped a fine of Rs 5,000 on Poojary and imposed an additional six months jail if he fails to do so. The court has also asked the jail authorities to take the convict to Nimhans, every six months for treatment.
